Notary services

The Embassy of the Republic of Moldova in Canada has authority to perform a variety of notarial services to its citizens. These services may include, but are not limited to, authentication of proxies (or “power of attorney”), legalization of signatures on statements and other documents, providing certified true copy (or “notarized copy”) etc.

AUTHENTICATION OF PROXIES (OR “POWER OF ATTORNEY”).

The proxies should be signed personally by the applicant at the Embassy headquarters in the presence of the consul.

In all cases, the content of the proxy and the powers which it gives shall be consulted in advance with a notary from the Republic of Moldova who will subsequently carry out transactions or inheritance actions based on the proxy issued in Canada.

The Embassy authenticates proxies by which someone gives authorization to be represented by another person on his/her behalf in private affairs, business, or some other legal matter.

In order to authenticate the power of attorney you have to be personally present at the Embassy, bringing the following documents:

  • an original valid identity document (passport or identity Moldovan card);

  • a copy of the identity card of the authorized person (or “the agent”);

  • other useful information, if appropriate.

For proxies regarding the sale, donation, or alienation in any form of real estate (residential real estate, industrial real estate, vacant land etc.) it is compulsory to present extracts from the Cadastral Register or the exact information regarding the address and the cadastral numbers of the real estate mentioned in the proxy.

Power of attorney for the settlement of an inheritance action must be accompanied by the deceased's certificate of death.

When filling the power of attorney for an inheritance action, the applicant must check in advance the status of the real estate transferred. It should be verified if the real estate was previously privatized, or if the property was simultaneously owned by several persons before the death occurred.

NOTARIZED MINOR TRAVEL DECLARATION.

The applicant must be personally present at the Embassy headquarters in order to complete the minor travel declaration himself/herself. The declaration of only one parent will suffice, regardless if he/she is married or divorced.

Required documents:

- the parent's Moldovan passport or identity Moldovan card;

- a copy of the Moldovan passport of the child. If your child also has a Canadian passport, it is required to present both;

- a copy of the Moldovan and Canadian passport (if that is the case) of the person who will accompany the child.

The declaration can be issued for a trip or multiple trips during a determined period of time. Usually for the duration of the summer vacation or for a period of several months.

LEGALIZATION OF SIGNATURE ON DECLARATIONS

In order to legalize the signature on requests and declarations, you have to be personally present at the Embassy, bringing the following documents:

  • an original valid identity document (passport or identity card);

  • the exact information regarding the name, first name, date and place of birth, address of permanent residence (as the case may be: the number, date and place of issue, the issuing authority of the identity document) of the person in whose interest the signature on the declaration is confirmed.

  • other useful information; if appropriate.

The declarations and requests should be signed personally by the applicant at the Embassy headquarters in the presence of the consul.

CERTIFIED TRUE COPIES OF STUDY DIPLOMAS.

In order to certify the photocopies (xerox) of the original documents issued by the competent authorities of the Republic of Moldova, the applicant should be personally present at the Embassy headquarters, bringing the following documents:

  • an original valid identity document (passport or identity Moldovan card);

  • the original document whose photocopy is to be legalized;

  • special requirements on the copy of the original document: If the document contains more than one page, copies of each page should be made separately. That is, 2 xerox copies on a double-sided sheet are not accepted. The copies should be made so as to contain all the contents of the original document, without containing erasures, or cut portions. Eventually, the photocopier may be set to smaller size so that your copy contain absolutely all parts of the original document.

You can also send your application for certified true copies through Canadian postal companies. In this case, the envelope will contain the original documents, the copies presented following the special requirements, the copy of the Moldovan identity document (Moldovan passport or ID card) + a Money order issued by the Canadian Post or a bank in Canada, on behalf of the Embassy of Moldova in Canada: “Money order to Embassy of Moldova”. Bank receipts are not required for issuing the check to the Bank or the Post Office. Thus, just the "Money order to Embassy of Moldova" is enough. For return of your certified true copies, the envelope should contain an additional prepaid envelope, of appropriate size, so that it can contain the original documents and the certified true copies.
